Help America Vote Act
In 2002, President George W. Bush signed HAVA. The law included new federal election requirements such as the replacement of outdated voting equipment, the creation of centralized Statewide databases of registered voters, and improvements to the administration of elections.

Persons who believe that a violation of Title III of HAVA has occurred, is occurring or is about to occur relating to voting system standards, provisional ballot voting, registration under the statewide voter registration system or registration by mail.
2009 Updates to 2006 State HAVA PlanBack/Close
Under the Help America Vote Act, the State must submit a plan that says how the State will or expects to spend federal funds to satisfy the requirements of the Act. Once submitted to the U.S. Election Assistance Commission, the plan must be updated and resubmitted every time a material change occurs. A material change might be a change in state or federal law, a change in the timeframe for getting funds, a change in the actual or proposed budget, or a change in the scope of a project or program. Material changes have occurred since the State last submitted the HAVA State Plan in 2006. The Secretary of State is the chief election official for Florida responsible for developing and amending the Plan. This is done through the help of a Committee. On March 23, 2009, the 2009 HAVA State Planning Committee met in Tallahassee, Florida. The Committee developed amendments that update Element #1 (Use of Title III Requirements Payments for Voting Systems), Element #6 (HAVA Budget), Element #12 (Summary of Material Changes to HAVA State Plan) and Element #13 (HAVA State Plan Committee and Procedures for Submission). An open comment period was held from April 10, 2009 through May 10, 2009. The HAVA State Plan as updated was submitted to the U.S. Election Assistance Commission on May 12, 2009 for further publication in the Federal Register. These 2009 Updates replace the version of the elements that currently exists in the 2006 HAVA State Plan. To the extent applicable, they universally update parts of all other Elements of the Plan that have to do with the same subject.
